Terms of service
The agreement between you and ROOTLESS ENTREPRENEUR LLC when you use implements.
Last updated
Who you are agreeing with
implements is run by ROOTLESS ENTREPRENEUR LLC, identification number 001435285, of 33 Valleywood Rd, Hopkinton, MA 01748, USA. In these terms "we" and "us" mean that company, and "you" means the person using the service. Writing to support@implements.app reaches us.
Using implements means you accept these terms. If you do not accept them, please do not use the service.
What the service is
implements is a collection of small web tools. One subscription gives you access to every tool in the catalog, including any we add while your subscription is active. Tools run in your browser and can be installed to your home screen. Some keep working offline and sync when you are online again.
We may add, change or remove individual tools. If we remove a tool you rely on, we will say so on the site before it goes.
Your account
- You need an account, and an email address that reaches you, to subscribe.
- Keep your password to yourself. You are responsible for what happens under your account. Tell us at once if you think someone else has got into it.
- One account is for one person. Do not share it.
- You must be old enough to enter a contract where you live, and at least 13.
Subscription, renewal and cancellation
- Subscriptions are monthly or yearly, and the prices are shown on the pricing page before you pay.
- Your subscription renews automatically at the end of each period, at the same price, until you cancel. Payments are taken by Stripe from the card you gave.
- You can cancel at any time from Billing in your account, which opens Stripe's customer portal. Cancelling stops the next payment and keeps your access until the end of the period you have already paid for.
- Refunds are covered by the refund policy, which is part of these terms. In short: you may ask for a full refund within 14 days of your first payment.
- We may change prices. A change never affects a period you have already paid for, and we will tell you by email at least 30 days before it applies to your renewals.
- If a payment fails, we may suspend access until it goes through. Stripe usually retries a failed payment for a few days.
Prices are in US dollars unless stated otherwise. You are responsible for any tax that applies where you live, unless we are required to collect it.
What you put into the tools
Your content stays yours. You give us only the permission needed to store it and show it back to you, and to the people you share it with.
Some tools make a share link, such as a poll or a trip. Anyone with that link can see what it points at, without an account. Send those links only to people you mean to see them. You can replace a link at any time in the tool's settings, which makes the old one stop working.
You are responsible for what you put in, including anything about other people, such as names, phone numbers or ways to pay. Only enter details you have the right to share.
Acceptable use
Do not use implements to:
- break the law, or help anyone else do so;
- store or share material that is unlawful, abusive, or infringes someone's rights;
- attack the service or the people using it: probing for weaknesses, getting around limits or access checks, scraping in bulk, or sending automated traffic beyond ordinary use;
- resell the service, or share one account with many people.
Security research is welcome. Write to support@implements.app before testing anything that could affect other people, and give us a reasonable time to fix what you find.
Availability
We work to keep implements running, but we do not promise it will always be available or free of faults. Maintenance, a failure at one of the services we depend on, or something we have not thought of can interrupt it. Installed tools that work offline may keep running while the site is down.
The service is provided "as is", without warranties of any kind, to the extent the law allows. Nothing here takes away rights your local consumer law gives you.
Keeping your own copies
We take reasonable care of your data and the database is backed up daily, but you should keep your own copy of anything you would hate to lose. Ask us and we will send you a copy of your data.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or anything that follows from your use of the service beyond what a reasonable person would have expected. Our total liability in any 12-month period is limited to what you paid us in that period.
Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
Ending the agreement
You can stop at any time: cancel the subscription, and delete your account from the account page when you want your data gone. Deleting is immediate and cannot be undone.
We may suspend or close an account that breaks these terms, or where we must by law. Unless the breach is serious, we will tell you first and give you a chance to put it right. If we close your account without cause, we refund the unused part of the period you paid for.
Changes to these terms
We may change these terms. For a change that affects your rights in a meaningful way, we will email subscribers at least 30 days before it takes effect. Using the service after a change takes effect means you accept the new terms; if you do not, cancel before then.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law rules, and the courts of Massachusetts have jurisdiction. If you are a consumer elsewhere, this does not take away the protection of the mandatory law of the country you live in, nor your right to bring a case there.
